We’ll go above and beyond to get you the results you want.

We promise to do what it takes to get you the results you had hoped for at no additional cost.

The scope of your project(s) will be clearly defined during the proposal process. That means the positive marketing results that you’re expecting need to be within the realm of the project we’re working on together.

For example, let’s say you’re working with ACS on an email marketing campaign and our goal is to increase book sales on your website. A positive marketing result means that your online book sales went up and those results can be at least partly attributed to email marketing. Score! If book sales don’t increase, our promise to you means that we’ll keep trying alternative email marketing tactics until we find something that DOES work to boost your book sales.

Does this mean we’ll run a full-page print ad in the New York Times to boost your book sales? No. That’s beyond the scope of an email marketing project and would incur additional costs. Will we test, modify, test, change, redesign, and test, test, test your email campaigns until we boost your sales? Yes.

Now, if for some reason you also sell shoes on that same website and your shoe sales remain the same or decrease during the book sales boost, our satisfaction guarantee doesn’t cover you here. Why? Because boosting your shoe sales wasn’t part of the project scope and was not one of our marketing goals.

Refunds WILL NOT BE PROCESSED ON A RESULTS BASIS. Aware Creative Solutions does not guarantee results or desired outcomes after purchase. We do promise to do whatever we can to get you real, measurable marketing results that help you grow your business.

Personalized Page Speed Report 30 Day Satisfaction Guarantee

If you follow our report’s step-by-step guide on your site and haven’t seen a dramatic increase in page load time within 30 days from your date of purchase, we will give you a full refund.

Before requesting a refund, we ask that you speak to one of our web experts to find out what’s not working for you.fo

This does not mean you should expect a .004 second load time for your website. Every site is different and there are some things you cannot speed up without digging into your website’s theme code (not covered in your Personalized Page Speed Report).

Take your chosen WordPress theme, for example. Some themes have a lot of overhead: un-optimized graphics, lots of external scripts, poor code. A dramatic increase in load time means that your site is noticeably faster after following our step-by-step guide. This could be a decrease from 7 seconds to 3 seconds, or from 4 seconds to 1 second. The guarantee doesn’t promise that your site will reach a specific load time. It unquestionably promises that it will load faster if you follow the directions.

Terms & Conditions

Content Ownership

Any elements of text, graphics, photos, contents, trademarks, or other artwork furnished to the Client for inclusion in marketing materials are owned by Client.

Promotional Use

The Aware Creative Solutions (the “Agency”) retains the right to display graphics and other content elements as examples of their work in their portfolio and as content features in other projects.

Indemnification & Liability

Client agrees and acknowledges to indemnify Agency from any liability, loss, claims and expenses related to any or all marketing services that are not the result of a breach of this Proposal or otherwise the fault of Agency. Under no circumstance and without limitation shall Agency be held liable for any indirect, incidental, special or consequential damages from the use of its services. The Agency assumes Client has permission from the rightful owner to use any code, scripts, data, images and reports that are provided by Client for inclusion in its materials, and will hold harmless, protect, and defend the Agency from any claim or suit arising from the use of such work. Agency does not guarantee results or desired outcomes after purchase.

Printing

While the Agency takes all care to avoid errors, the Agency accepts no responsibility for typographical errors, spelling mistakes, or incorrect information on any project committed to print or production. It is the Client’s responsibility to proofread and approve all final copy before the production of artwork. The email verification of the Client’s representative shall be conclusive as to the approval of all artwork prior to their release for printing, implementation or installation. There will be no reprints at the expense of the Agency.

Privacy Requirements, GDPR & Legal Responsibilities

The Agency is not a qualified legal advisor or a privacy regulation expert and cannot offer legal advice regarding privacy and data requirements to which the Client’s business should adhere. Any concerns the Client has regarding any of the marketing work the Agency performs should be reviewed with Client’s own legal counsel.

Confidentiality

In the performance of its services under this agreement, the Agency will have access to proprietary and confidential information relating to Client’s products, services customers, prices, products and general business operations. The Agency, for itself, its employees, agents and successors, acknowledges the confidential and secret nature of such information and agrees not to reproduce such information without the prior written consent of Client, not to use the information except in the ordinary course of performance of this agreement, and not to divulge all or any part of the information to any third party, either during or after the term of this agreement.
